§ 1 Scope and Provider

(1) These General Terms and Conditions apply to all orders you place in our online shop.

(2) The offer is directed exclusively at adult buyers (aged 18 and over).

(3) Our deliveries and offers are made exclusively on the basis of these General Terms and Conditions.

(4) The language of the contract is exclusively German.

(5) You can access and print the current version of these Terms and Conditions at any time on our website.

§ 2 Conclusion of Contract

(1) The product presentations in the shop do not constitute a legally binding offer, but rather a non-binding invitation to place an order.

(2) By clicking on “Buy now” you are submitting a binding offer to purchase.

(3) After submitting your order, you will receive an automatic confirmation of receipt by email; this does not yet constitute acceptance.

(4) The contract is concluded when we expressly confirm the order or dispatch the goods. In the case of payment via PayPal or credit card, the contract is concluded immediately upon placement of the order.

§ 3 Prices

(1) All prices are final prices in accordance with Section 19 of the German VAT Act (small business regulation) ; no VAT is shown.

(2) The shipping costs shown in the respective advertisements will be added.

§ 4 Payment Terms

(1) Available payment methods: PayPal and credit card .

(2) The invoice amount is due immediately. PayPal's terms of service apply.

§ 5 Delivery and Retention of Title

(1) Delivery within the European Union (main focus on Germany) to the delivery address you have provided.

(2) Production time is usually 2–3 working days (handmade) plus shipping time with Deutsche Post / DHL.

(3) The goods remain our property until full payment has been received.

§ 6 Handwork, Material & Safety

(1) Our products are handmade ; slight variations in color, shape or structure are characteristic and not a defect.

(2) Candles: 100% natural soy wax , cotton wick , gently scented. People with allergies should use scented products with caution.

(3) Safety instructions: Always place candles on a fireproof surface , do not leave burning unattended, and keep away from children, pets, and flammable materials. Burning time per session: max. 3–4 hours.

(4) Packaging: Each candle is supplied in a sturdy gift box (cardboard or metal) with instructions for safe use.

§ 7 Cancellation, Return & Exchange

(1) Returns and exchanges are possible within 14 days ; return shipping costs are borne by the customer.

(2) Excluded from the right of withdrawal are personalized or custom-made products and candles that have already been lit/damaged.

(3) After receipt of the return, the processing time is up to 7 working days .

§ 8 Warranty

The statutory provisions of the German Civil Code (BGB) regarding the sale of goods apply (§§ 433 et seq.). For consumers, the limitation period for claims based on defects is two years from delivery.

§ 9 Liability

(1) Unlimited liability in cases of intent, gross negligence and in accordance with the Product Liability Act; also for damages resulting from injury to life, body or health.

(2) In cases of slight negligence, we shall only be liable for breaches of essential contractual obligations (cardinal obligations) and limited to the typically foreseeable damage.

§ 10 Alternative Dispute Resolution

The EU Commission provides a platform for online dispute resolution: http://ec.europa.eu/consumers/odr/ .
We strive to resolve disagreements amicably. We are not obligated to participate in arbitration proceedings.

§ 11 Final Provisions

(1) German law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

(2) Should individual provisions be invalid, the validity of the remaining provisions shall remain unaffected.

(3) To the extent permitted by law, the place of jurisdiction shall be the registered office of the owner in 78224 Singen, Germany.
